A new ruling expands the definition of “active users” — and raises the bar for digital transparency.

The General Court of the European Union has confirmed that Zalando qualifies as a Very Large Online Platform (VLOP) under the EU’s Digital Services Act (DSA).

The decision clarifies that platforms must include all individuals who interact with their content when calculating the number of “active users” — not only registered users or paying customers. This broad interpretation means that even visitors who simply browse product listings count toward the total.

The ruling is significant because it establishes a uniform and quantifiable method for determining which platforms fall under the DSA’s stricter transparency, compliance, and consumer protection requirements. In practice, this places Zalando in the same category as Amazon, eBay, YouTube, and TikTok — companies that must now implement stronger oversight, complaints handling, and accountability mechanisms to ensure a safer and fairer digital environment.
